Right of publicity question of the day

Put someone's image on a playing card.  Violation of the right of publicity?  Newsworthy?  Transformative?  What if the image is on the cards in order to solve a cold case?  Please discuss!

You know when the internet bubble burst and then we had Enron and Worldcom, 2 people created card decks picturing all of the individuals who had been involved in scandals - Ken Lay, Bernie Ebbers, Frank Quattrone, etc - one deck was called "Shareholders' Most Wanted." One of the people on the cards threatened a lawsuit, but my firm sent them a letter about SLAPP suits and it went away. - Ann Lipton
