Sizable damages award in NetQuote case
Following up on previous posts (this is the most in-depth post) on this somewhat unusual false advertising case: The claims were based on defendant's employee's submission of false insurance leads to plaintiff's site; defendant added insult to injury by then advertising that it had better-quality leads than plaintiff. NetQuote's attorney Dan Williams of Faegre & Benson reports that the jury returned a verdict in favor of NetQuote, awarding $1.6 million in actual damages and $3.2 million in punitive damages (plus $1000 from an individual defendant). Quite a good result for NetQuote, though given recent trends in punitive damages even a 2:1 ratio might be hard to sustain.
