My latest article, written with Bruce Keller of Debevoise & Plimpton: Even More Parodic than the Real Thing: Parody Lawsuits Revisited.
Really neat paper on noncommercial creativity: Amateur-to-Amateur by Dan Hunter & F. Gregory Lastowka. It's a slightly different take on the implications of having a huge mass of creativity generated by people who don't expect to get paid -- and who expect to be able to take advantage of preexisting materials, too.
