Best in show, sort of

You may have seen this story about CNET's removal of a Dish product from consideration in its "Best of CES Awards" because of litigation between Dish and CNET's parent.  But did you consider the advertising law implications?  Can Dish advertise its initial finalist status?  Can competitors truthfully advertise that they won "Best of" when an important contender was excluded for reasons no one could say were related to the merits of the contest?

Update: apparently, the Dish product actually won before CBS forced a re-vote.  If I were the other "winner," I'd be hesitant to advertise the honor.  Is it even literally true to say that the other "won"?
