Eric E. Johnson,
Intellectual property's need for a disability perspective, 20 Geo. Mason U. Civ. Rts. L.J. 181-208 (2010). Notable for, among other things, trenchant criticism of nominative fair use doctrine. Bitter irony: the PDF available online is an image scan.
Great image, thx. Disabilities, accessibility & copyright are of great interest to me. We need more then fair use to enable access for all people.

Your criticism is well-deserved. I asked the journal for a pdf some time ago, and in the interim, I scanned in the printed version myself, with plans to replace it with the text-based file. I would be the first to argue that an image-based pdf is not an acceptable format for distributing a new journal article. I am now following up with the journal to get a text-based replacement as soon as possible. Thanks for reminding me of the importance of this.
ReplyDeleteI've been in that situation myself--in one case, I ended up using the Lexis version, though it's not pleasant to look at, to pair with the image-based PDF because I wasn't going to get a better PDF out of the journal. I hope you get your version soon!
